1.3 For the purposes of this part of the Terms and Conditions, the consumer shall mean the buyer. For the purposes of this part of the Terms and Conditions, the trader shall mean the seller.
1.4 For the purposes of these Terms and Conditions, a consumer is a natural person who, in connection with a consumer contract, an obligation arising therefrom, or in commercial practice, does not act within the scope of their business or profession.
1.5 When placing an order, the consumer shall provide their name, surname, postal and billing address, telephone number, and e-mail contact.
1.6 The General Terms and Conditions form an integral part of the consumer contract. If the trader and the consumer enter into a written consumer contract stipulating conditions different from the General Terms and Conditions, the provisions of the consumer contract shall take precedence over the General Terms and Conditions.
2. Method of Concluding a Consumer Contract
2.1 A consumer contract is concluded by the binding acceptance of the consumer's proposal to conclude a consumer contract by the trader in the form of a form completed and sent by the consumer on the trader's website – kvalitne-vino.eu (hereinafter referred to as the "order"). All prices for goods and services and all fees in the online store are stated in EUR including VAT. A condition for concluding a consumer contract is the truthful and complete completion of all data and requisites required when placing the order.
2.2 The binding acceptance of the consumer's order is the e-mail confirmation by the trader of the acceptance of the order after prior receipt of the order and after verification of the availability of the goods, current prices, and delivery date of the goods requested by the consumer, marked as "order confirmation". In the event of finding a higher price, the trader has the obligation to obtain the consumer's consent to the price change according to the current price list before confirming the order. Only upon the consumer's consent to the price change and subsequent confirmation (acceptance) of the order by the trader shall the contractual relationship be deemed concluded. All prices for goods and services and all fees in the online store are stated including VAT.
2.3 The binding acceptance of the order contains in particular the data on the name and specification of the goods whose sale is the subject of the consumer contract, further data on the price of the goods and/or other services, data on the delivery time of the goods, the name and data on the place where the goods are to be delivered, and data on the price, conditions, method, and date of transport of the goods to the agreed place of delivery of the goods for the consumer, data on the trader (business name, registered office, ID No., commercial register entry number, etc.), possibly other data.
2.4 In the event of detecting an error in the submitted order, the consumer may contact the trader by phone or e-mail (contact details are provided at the beginning of these terms and conditions).
2.5 The consumer may deliver to the trader, by electronic mail or telephone, within 24 hours of the order being received by the trader, a notice that they are cancelling the order if a valid contract has not yet been concluded within the meaning of Art. 2. This provision does not affect the consumer's right to withdraw from the contract (if already concluded), the subject of which is the delivery of goods, even before the withdrawal period begins to run. The consumer is obliged to state in the notice of cancellation the name, e-mail, and description of the ordered goods. If the consumer has paid the purchase price or part thereof to the trader at the time of cancellation of the order, the trader shall refund the already paid purchase price or part thereof within 14 days of the cancellation of the order, using the same method the consumer used for their payment.
2.6 According to Act No. 222/2004 Coll. on Value Added Tax, the data in an already issued tax document (invoice) cannot be changed. Data in the tax document (invoice) can only be changed if the consumer has not yet received and paid for the goods.
2.7 In the case of ongoing promotions, the sale of goods on the trader's website is governed, in addition to these General Terms and Conditions, also by the binding conditions of the relevant promotion. If the consumer orders goods in violation of the conditions of the relevant promotion, the trader is entitled to cancel the consumer's order. The consumer will be informed of the cancellation via e-mail, and in the event of payment of the purchase price or part thereof, the funds will be returned within 14 days to the account designated by them, unless agreed otherwise with the trader.
3. Rights and Obligations of the Trader
3.1 The trader is obliged to:
- a) deliver to the consumer, on the basis of an order confirmed by the trader, the goods in the agreed quantity, quality, and time, and pack them or prepare them for transport in a manner necessary for their preservation and protection,

- k) when selling or providing a product, observe the principle of equal treatment towards the consumer, provide the consumer with a service in a safe manner and with professional care,

- n) when withdrawing from a contract, round the cash payment for the product,
- o) provide cooperation to the Ministry of Economy of the Slovak Republic in out-of-court settlement of a cross-border dispute between the consumer and the trader through the network of European Consumer Centres.
3.2 The trader has the right to proper and timely payment of the purchase price from the consumer for the delivered goods.
3.3 Before the binding acceptance of the order, the trader has the right to cancel the order if, due to stock depletion or unavailability of goods, they are unable to deliver the goods to the consumer within the period specified by these Terms and Conditions or at the price stated in the online store, unless they agree with the consumer on alternative performance. The consumer will be informed of the cancellation of the order via e-mail, SMS, or letter.
3.4 The trader reserves the right to verify the identity of the consumer or the person authorized to collect the goods during personal collection of the goods, in cases where the delivery of the goods is prepaid by the consumer by card, bank transfer, or by invoice with a due date.
4. Rights and Obligations of the Consumer
4.1 The consumer is obliged to:
- a) take over the purchased or ordered goods,

- c) not damage the good business name of the trader,
- d) confirm the receipt of the goods in the delivery note by their signature or the signature of a person authorized by them.
4.2 The consumer has the right to delivery of the goods in the quantity, quality, time, and place agreed by the parties in the binding acceptance of the order.
4.3 The consumer has the right to:
- a) protection of health, safety, and economic interests,
- b) information to the extent and under the conditions set out in this Act and legally binding acts of the European Union,
- c) exercise rights arising from liability for defects of the product,

- e) adequate financial satisfaction from the person who violated the consumer's rights or obligations in the field of consumer protection, if the consumer successfully asserts before a court the violation of a right or obligation in the field of consumer protection; when determining the amount of adequate financial satisfaction, the court shall take into account in particular the nature, severity, manner, extent, consequences, duration, and circumstances of the violation of the consumer's right or obligation in the field of consumer protection.
5. Delivery and Payment Terms
5.1 The trader arranges transport only within the territory of the Slovak Republic. If the consumer wishes to have the goods sent abroad, such transport cannot be arranged. In any case, the contractual relationship where the consumer is a foreigner shall be governed by the Slovak legal order, and in the event of a dispute, the court locally and substantively competent in the Slovak Republic shall have jurisdiction.
5.2 The trader enables the following methods of delivery of goods to the consumer:
- a) Personal collection,
- b) Via a delivery intermediary (courier).
5.3 The trader undertakes to deliver the ordered goods to the buyer within a reasonable period (hereinafter also referred to as the "delivery period"). Deliveries of goods whose order the trader has confirmed will be made according to the trader's operational capabilities, usually from 4 hours to 5 working days from the binding confirmation of the order. In exceptional cases, the trader may unilaterally extend the delivery period, even repeatedly. The trader reserves the right to extend the delivery period in cases of force majeure or in cases where delivery cannot be made within the usual delivery period for objective reasons. In the event of a change in the delivery period, the trader shall inform the consumer thereof by electronic message (e-mail) or SMS message. The consumer is subsequently informed about the dispatch of the goods or their preparation for personal collection by electronic message (e-mail) and/or SMS message.
5.4 The trader states the options for delivery of Goods and/or Services and the fees for these individual options for delivery of Goods and/or Services (valid for the entire territory of the Slovak Republic).
5.5 If the trader has failed to fulfill their obligation to deliver the goods within the agreed period, the consumer shall invite them to deliver the goods within an additional reasonable period provided by the consumer. If the trader fails to deliver the goods even within this additional reasonable period, the consumer is entitled to withdraw from the contract. The consumer may also withdraw from the contract without providing an additional reasonable period if:
- a) the trader refused to deliver the goods,
- b) timely delivery was of exceptional importance given all the circumstances of the conclusion of the contract,
- c) the consumer informed the trader before concluding the contract that timely delivery is of exceptional importance.
5.6 The trader reserves the right to refuse an order and/or withdraw from the contract for the purchase of goods:
- a) of a non-standard or speculative nature,
- b) due to stock depletion of the goods, their unavailability, or if the manufacturer discontinued production or made such significant changes that prevented the fulfillment of the trader's obligations arising from the consumer's order, or due to force majeure,
- c) if, even after exerting all efforts that can be reasonably required of the trader, they are unable to deliver the goods to the consumer within the period specified by these General Terms and Conditions or at the ordered price.
5.7 If the chosen method of transport is via a delivery intermediary, the trader shall deliver the ordered goods to the consumer at the address that the consumer provided as the delivery address in the order. Installation or other actions (e.g., unloading of goods, etc.) are not part of the delivery of goods. The consumer is obliged to take over the goods at the place of delivery in person or to ensure that the goods are taken over by a person authorized by them for the case of their absence for receipt of goods. The authorized person for receipt of goods is obliged to present to the trader or the delivery intermediary the original written authorization. If the subject of delivery is goods whose sale is conditional upon the consumer reaching a minimum age under special regulations, the trader or the delivery intermediary has the right to verify that the consumer has reached the age entitling them to take over the goods.
5.8 An order placed as cash on delivery that is not collected at the time of delivery or repeated delivery by the delivery service intermediary shall be cancelled.
5.9 If the consumer chooses the method of delivery as personal collection, the goods are prepared by the trader for collection after sending a notice of the possibility of their collection at the trader's address or at the trader's warehouse. The addresses of the premises and the operating hours of the place of personal collection are available when creating the order and/or when confirming the order by the trader. If the consumer does not take over the goods within 7 days after the expiry of the notice of the possibility of their collection, the trader is entitled to withdraw from the contract for the purchase of goods.
5.10 The trader shall hand over to the buyer, upon personal collection or in the shipment with the goods, a tax document (invoice). The trader may also send the tax document (invoice) to the consumer in electronic form (hereinafter referred to as "electronic invoice") to the consumer's e-mail address. For this purpose, an electronic invoice means an electronic document in PDF format, which is, but not necessarily, signed by the trader's electronic signature according to a special regulation, whereby the electronic invoice is a full-fledged replacement of an invoice – a tax document in paper form.
5.11 The trader is entitled to invite the consumer to take over the goods before the expiry of the period agreed in the consumer contract.
5.12 The consumer is entitled to inspect the shipment, i.e., the goods as well as their packaging, immediately upon their delivery. If the consumer finds that the goods or the packaging of the goods are mechanically damaged, they are entitled to notify the carrier of this fact and, in their presence, check the condition of the goods. In the event of finding damage to the goods upon their receipt by the consumer, the consumer has the option to immediately refuse to take over the goods upon receipt. The carrier is obliged to draw up a so-called damage report in the presence and at the request of the consumer regarding the damage to the goods. Based on such a record delivered to the trader, the trader may, after closing the damage event with the carrier, provide for the removal of the defect in the goods, a discount on the goods, and in the case of irreparable defects in the goods, deliver new goods to the consumer. Later complaints of this type will need to be proven. An incomplete or damaged shipment must be reported without delay via e-mail to the address: [email protected] and a damage report must be drawn up with the carrier and sent without undue delay by e-mail or post to the trader's address. Otherwise, a complaint of this type of goods can only be recognized if the consumer proves that the complained defects were present in the goods at the time of their receipt.
5.13 In the event of non-delivery of the goods by the trader within the period specified in these Terms and Conditions, the consumer is entitled to withdraw from the consumer contract, and the trader is obliged to refund the already paid part of the purchase price to the consumer without undue delay, but no later than 14 days from receipt of the withdrawal from the consumer contract, using the same method the consumer used for their payment, unless they agree with the consumer on another method of return without the consumer being charged any additional fees.
5.14 The trader has the right to compensation for damage (pursuant to § 420 et seq. of the Civil Code) in the amount of actual costs in the event of an unsuccessful delivery of the order if the consumer ordered goods which they did not cancel or withdraw from the contract and at the same time did not take over these goods from the carrier or, after the trader's request, in the case of choosing personal collection, did not take over the goods at the designated place within the specified collection period. By this conduct, the consumer violated their obligation set out in point 4.1(a) of these Terms and Conditions, according to which the consumer is obliged to take over the ordered goods.
5.15 The trader also has the right not to exercise the right to compensation for damage or to exercise this right only in part.
5.16 If the goods are subject to a promotional price, it is valid from the date of publication of the promotion in the description of the goods or until the stock of these goods is depleted. Any additional discounts provided beyond the discounts listed for individual goods in the e-shop, individual discounts for the buyer, or discounts provided on the basis of contractual cooperation of the seller with third parties are not mutually combinable.
5.17 The shipping cost will be added to the price if the consumer has chosen the method of transport via a delivery intermediary (hereinafter also referred to as "carrier" or "courier") and if the value of the ordered goods does not exceed the value set by the trader, in which case the shipping cost is borne by the trader. The fact that shipping is provided at the trader's expense is stated in the order. The order value is stated throughout the entire purchasing process. The shipping price is determined according to the valid price list of the delivery intermediary.
5.18 Any difference between the sum of unit prices including tax and the total price is due to rounding.
5.19 The consumer may pay the price according to the order by:
- a) payment card (CardPay),
- b) internet banking payment gateway,
- c) bank transfer or deposit to the seller's account on the basis of a proforma invoice issued by the trader,
- d) cash on delivery (payment to the delivery intermediary upon receipt of goods),
- e) gift vouchers.
5.20 Payment by bank transfer must be made within 3 days from the date of order confirmation, otherwise the order is cancelled. Goods or services offered in a promotion or as part of another benefit may not be available at the time of payment when choosing the bank transfer payment method, and the company does not guarantee their availability with this method of payment.
5.21 The trader reserves the right to temporarily or permanently restrict payment methods for technical reasons, due to obstacles on the part of the trader or the intermediary of these services, or due to force majeure.
5.22 The trader does not charge a fee for payment, except for payment to which an additional service is attached (e.g., cash on delivery).
5.23 Payment means the moment the price is credited to the seller's bank account or the moment the payment intermediary confirms its execution.
6. Purchase Price
6.1 The consumer is obliged to pay the trader the purchase price of the goods agreed in the consumer contract and/or according to the trader's price list valid at the time of conclusion of the consumer contract, including the costs of delivery of the goods (hereinafter referred to as the "purchase price"). All prices stated on the trader's website are final. The price of the goods does not include the cost of transport and packaging. For the goods, the consumer pays the price stated on the trader's website at the time of placing the order. Individual discounts for consumers are subject to a separate agreement. Prices of individual products are stated including value added tax (VAT) and all other taxes. In the event of a change in the VAT rate, the valid VAT rate at the time of issuing the tax document will be charged. For the goods, the consumer pays the price stated on the trader's website at the time of placing the order.
6.2 The final price is stated in the order form just before sending the order, it is stated including VAT, possibly all other taxes and fees (packaging, postage...) that the consumer must pay to obtain the product or service. This price cannot be unilaterally changed by the trader.
6.3 The consumer is obliged to pay the trader the purchase price for the agreed goods within the period according to the consumer contract, but no later than upon receipt of the goods.
6.4 If the consumer pays the trader the purchase price for the goods agreed in the consumer contract, the consumer is entitled to withdraw from the consumer contract and demand a refund of the purchase price only in accordance with the valid legal regulations of the Slovak Republic.
6.5 Costs associated with carrying out the goods are not included in the purchase price of the goods, and the trader is not obliged to provide these services to the consumer.
6.6 All promotions are valid while stocks last, unless stated otherwise for a specific product.
6.7 If the purchase price for returned or complained goods and goods for which withdrawal from the contract has occurred is paid by the consumer in the form of gift certificates, or possibly their combination with monetary payment, the trader shall refund the purchase price to the consumer in the same form as it was paid by the consumer (i.e., using the same method the consumer used for their payment, unless they agree with the consumer on another method of return without the consumer being charged any additional fees).
6.8 No goods of the trader are intended for industrial or professional use. The trader's goods are not intended for resale.
7. Acquisition of Ownership and Passing of Risk of Damage to Goods
7.1 Upon taking over the goods at the agreed place, the ownership right to the goods passes to the consumer. A consumer who does not meet the definition of a consumer stated in these Terms and Conditions acquires ownership of the goods only upon full payment of the entire purchase price for the goods. Goods are deemed delivered upon taking over the goods in person or at the moment of their receipt from the transport company.
7.2 The risk of accidental destruction, accidental deterioration, loss of the item, or other damage to the goods passes to the consumer at the moment of delivery of the goods by the trader, or if they do not do so in time, at the time when the trader enables them to dispose of the goods and the consumer does not take them over.
8. Conformity with the Purchase Contract
8.1 The sold item must have the agreed or legally stipulated quality, quantity, measure or weight, execution, and must be free of defects, in particular it must comply with binding technical standards. If special rules need to be observed when using the item, the trader is obliged to inform the consumer thereof, unless these are generally known rules.
8.2 The display of color shades depends, among other things, on the quality of the monitor used or other display device.
9. Complaint Procedure (Liability for Defects, Warranty, Complaints)
9.1 The trader is liable for defects of goods inconsistent with the contract that the goods have upon receipt by the consumer and for defects and deficiencies of goods that appear after receipt of the goods during the warranty period, which in the case of food is the minimum durability date or the use-by date. Goods marked as food retain the required quality and health safety until the specified date, which is the use-by date or the minimum durability date marked on the product packaging. In the case of perishable food, the complaint must be made no later than the day following the purchase, otherwise the consumer's right lapses. Details on complaints are governed by the complaint procedure.
9.2 The handling of complaints is subject to this Complaint Procedure, published on the seller's website kvalitne-vino.eu. By checking the box before sending the order to the trader, the consumer confirms that they have read and fully agree with the Complaint Procedure, and at the same time confirms that they have been properly informed about the conditions and method of complaining about the goods, including information on where the complaint can be filed.
9.3 The Complaint Procedure applies to goods purchased by the consumer from the trader in the form of e-commerce on the trader's e-commerce website.
9.4 The Complaint Procedure in this form is valid for all business cases, unless other warranty conditions are contractually agreed.
9.5 The consumer has the right to assert during the warranty period with the trader liability for defects of goods that shows defects for which the manufacturer, supplier, or trader is responsible, which is covered by warranty and was purchased from the trader, and if they prove that the goods were purchased from the trader and are within the warranty period (e.g., by a payment receipt, warranty certificate, etc.).
9.6 The consumer is entitled to inspect the goods upon receipt. If they do not do so, the trader is liable for defects in the goods discovered during this inspection if it is proven that these defects were present in the goods at the time of receipt.
9.7 During the warranty period, the consumer has the right to free removal of the defect after presenting the goods including accessories, documentation, instructions to the authorized representative of the trader, and proving that the goods were purchased from the trader and are within the warranty period (e.g., by a payment receipt, warranty certificate, etc.).
9.8 The consumer may exercise rights arising from liability for defects, or demand a complaint of the goods, only if they notified the trader of the defect within two months of discovering the defect, but no later than the expiry of the warranty period.
9.9 If the goods show defects, the consumer has the right to file a complaint at the trader's address stated in these Terms and Conditions by delivering the goods including accessories to the trader's address and filling out a complaint form and delivering it to the trader. The form shall be determined by the trader and its template shall be placed on the trader's website. The consumer is obliged to precisely state in the form the type and extent of the defects of the goods, as well as the time of discovery of the defect.
9.10 The trader recommends that the consumer insure the shipment with the goods. The trader does not accept goods sent cash on delivery.
9.11 The complaint procedure for goods that can be objectively delivered to the trader begins on the day when all of the following conditions are met:
- a) delivery of the completed complaint form from the consumer to the trader,
- b) delivery of the complained goods including accessories from the consumer to the trader.
The start of the complaint procedure is also the day of filing the complaint. The complained goods must be delivered to the trader's registered office, unless the trader or an authorized person determines otherwise (e.g., deliver the goods directly to the authorized person). In case of any uncertainty, please contact the trader's company.
The complaint form can be downloaded here (clicking here will display the complaint form).
The above recommendation for filing a complaint does not exclude the filing of a complaint by the consumer in another manner.
9.12 The trader is obliged to accept a complaint at any of their establishments where the acceptance of complaints is possible, i.e., at their registered office or at an authorized person.
9.13 At the place designated for receiving complaints according to these Terms and Conditions, the trader is obliged to ensure the presence of a person authorized to handle complaints.
9.14 If the trader is liable for a defect in the sold item, the consumer has the right against them to have the defect removed by repair or replacement, the right to a reasonable discount on the purchase price, or the right to withdraw from the consumer contract, pursuant to § 621(1) of the Civil Code.
9.15 The trader or an authorized person shall provide the consumer with written confirmation of the filing of a complaint about the goods, or of the notification of a defect, without delay after the defect is notified by the consumer, in a suitable form chosen by the trader, e.g., in the form of an e-mail or in written form.
9.16 The warranty does not apply to defects that the consumer was warned about by the trader at the time of concluding the contract, or that the consumer must have been aware of given the circumstances under which the consumer contract was concluded.
9.17 The warranty period is two years (unless a consumer warranty is provided for specific cases) and begins to run from the day of receipt of the goods by the consumer. If a period for use of the goods is stated on the goods, their packaging, or instructions in accordance with other legal regulations, the warranty period ends upon the expiry of this period. The defect in the goods and claims arising from the defect in the goods must be asserted by the end of the warranty period. Upon expiry of the warranty period, the right to file a complaint lapses. For goods sold at a lower price due to a defect, the warranty period is 24 months, but the trader is not liable for the defect for which the lower price was agreed (§ 619(1) of the Civil Code). For used items, the trader is not liable for defects arising from their use or wear. In this case, the warranty period is 12 months (§ 619(1) and § 620(2) of the Civil Code).
9.18 The trader shall state in the confirmation of receipt of the complaint a reasonable period within which the defect will be remedied. The period for remedying the defect is a maximum of 30 days from the date of notification of the defect, unless a longer period is justified by an objective reason beyond the trader's control.
9.19 If the trader refuses liability for defects, they shall notify the consumer in writing of the reasons for the refusal. If the consumer proves the trader's liability for the defect by an expert opinion or professional opinion issued by an accredited person, authorized person, or notified person, they may notify the defect repeatedly, and the trader cannot refuse liability for the defect.
9.20 The consumer has the right to choose the remedying of the defect by replacement of the item or repair of the item. The consumer cannot choose a method of remedying the defect that is not possible or that, compared to the other method of remedying the defect, would cause the trader disproportionate costs taking into account all circumstances, in particular the value the item would have without the defect, the severity of the defect, and whether the other method of remedying the defect would cause the consumer significant difficulties.
9.21 The trader may refuse to remedy the defect if neither repair nor replacement is possible or if they would require disproportionate costs taking into account all circumstances.
9.22 The trader shall repair or replace the item within a reasonable period after the consumer has notified the defect, free of charge, at their own expense, and without causing significant difficulties to the consumer, taking into account the nature of the item and the purpose for which the consumer required the item. For the purposes of repair or replacement, the consumer shall hand over or make the item accessible to the trader. The costs of taking over the item are borne by the trader.
9.23 In the case of replacement of the goods with new ones, the consumer shall receive a document stating the replaced goods, and any further complaints shall be made on the basis of the original delivery note and this complaint document. In the case of replacement of the goods with new ones, the warranty period shall begin to run anew from the receipt of the new goods, but only for the new goods.
9.24 The right to free warranty repair lapses:
- a) by failure to present the warranty certificate, accessories, or documentation of the goods,
- b) by failure to report obvious defects upon receipt of the goods,
- c) by expiry of the warranty period of the goods,
- d) by mechanical damage to the goods caused by the consumer,
- e) by using the goods in conditions that do not correspond, in terms of humidity, chemical and mechanical influences, to the natural environment,
- f) by unprofessional handling, operation, or neglect of care for the goods,
- g) by damage to the goods due to excessive loading or use contrary to the conditions stated in the documentation,
- h) general principles, technical standards, or safety regulations in force in the Slovak Republic,
- i) by damage to the goods due to unavoidable and/or unforeseeable events,
- j) by damage to the goods due to accidental destruction and accidental deterioration,
- k) by unprofessional intervention, damage during transport, damage by water, fire, static or atmospheric electricity, or other force majeure intervention,
- l) by interference with the goods by a person not authorized thereto.
9.25 The warranty does not apply to normal wear and tear of the item (or its parts) caused by use. A shorter lifespan of the product cannot therefore be considered a defect.
9.26 The trader shall deliver the repaired item or replacement item to the consumer at their own expense in the same or similar manner in which the consumer delivered the defective item, unless the parties agree otherwise. If the consumer does not take over the item within six months from the date they were supposed to take it over, the trader may sell the item. If it is an item of greater value, the trader shall notify the consumer of the intended sale in advance and provide them with a reasonable additional period to take over the item. After the sale, the trader shall immediately pay the consumer the proceeds from the sale of the item after deducting the costs reasonably incurred for its storage and sale, if the consumer exercises the right to a share of the proceeds within a reasonable period stated by the trader in the notice of the intended sale of the item. The trader may destroy the item at their own expense if it could not be sold or if the expected proceeds from the sale will not be sufficient even to cover the costs reasonably incurred by the trader for storage of the item and the costs that the trader would necessarily have to incur for its sale.
9.27 In the case of replacement of the goods with new ones, the consumer shall receive a document stating the replaced goods, and any further complaints shall be made on the basis of the original delivery note and this complaint document. In the case of replacement of the goods with new ones, the warranty period shall begin to run anew from the receipt of the new goods, but only for the new goods.
9.28 When remedying a defect by replacement of the item, the trader has no right to compensation for damage caused by normal wear and tear of the item and to remuneration for normal use of the item before its replacement.
9.29 If the trader concludes the complaint procedure as a justified rejection of the complaint, but the defect of the product objectively exists and has not been remedied, the consumer may assert their right to have the defect of the goods remedied through court.
9.30 The consumer has the right to a reasonable discount on the purchase price or may withdraw from the consumer contract even without providing an additional reasonable period if:
- a) the trader has not repaired or replaced the item,
- b) the trader has not repaired or replaced the item in accordance with § 623(4) and (6) of the Civil Code,
- c) the trader refused to remedy the defect because neither repair nor replacement is possible or would require disproportionate costs taking into account all circumstances, in particular the value the item would have without the defect, the severity of the defect, and whether the other method of remedying the defect would cause the consumer significant difficulties,
- d) the item has the same defect despite repair or replacement of the item,
- e) the defect is of such a serious nature that it justifies an immediate discount on the purchase price or withdrawal from the consumer contract, or
- f) the trader has declared or it is evident from the circumstances that the defect will not be remedied within a reasonable period or without causing significant difficulties for the consumer.
9.31 When assessing the consumer's right to a discount on the purchase price or withdrawal from the consumer contract, all circumstances shall be taken into account, in particular the type and value of the item, the nature and severity of the defect, and whether the consumer can objectively be expected to trust in the trader's ability to remedy the defect.
9.32 The discount on the purchase price must be proportionate to the difference between the value of the sold item and the value the item would have had if it had been free of defects.
9.33 The consumer may not withdraw from the consumer contract if the consumer contributed to the occurrence of the defect or if the defect is negligible. The burden of proof that the consumer contributed to the occurrence of the defect and that the defect is negligible lies with the trader.
9.34 If the contract concerns the purchase of several items, the consumer may withdraw from it only in relation to the defective item. In relation to the other items, they may withdraw from the contract only if it cannot reasonably be expected that they will have an interest in keeping the other items without the defective item.
9.35 After withdrawal from the contract or part thereof, the consumer shall return the item to the trader at the trader's expense.
9.36 After withdrawal from the contract, the trader shall refund the purchase price to the consumer no later than 14 days from the date of return of the item to the trader or upon proof that the consumer has sent the item to the trader, whichever occurs earlier.
9.37 The trader shall refund the purchase price to the consumer or pay them a discount on the purchase price using the same method the consumer used when paying the purchase price, unless the consumer expressly agrees to another method of payment. All costs associated with the payment are borne by the trader.
9.38 The trader has no right to compensation for damage caused by normal wear and tear of the item and to remuneration for normal use of the item before withdrawal from the consumer contract.
10. Withdrawal from the Consumer Contract, Impossibility of Withdrawal from the Consumer Contract
10.1 The trader is entitled to withdraw from the consumer contract due to stock depletion, unavailability of goods, or if the manufacturer, importer, or supplier of the goods agreed in the consumer contract has discontinued production or made such significant changes that prevented the fulfillment of the trader's obligations arising from the consumer contract, or due to force majeure, or if even after exerting all efforts that can be reasonably required of them, they are unable to deliver the goods to the consumer within the period specified by these Terms and Conditions. The trader is obliged to immediately inform the consumer of this fact and refund the already paid deposit for the goods agreed in the consumer contract without undue delay, but no later than within 14 days from the notification of withdrawal from the contract, using the same method the consumer used for their payment. This does not affect the consumer's right to agree with the trader on another method of payment, provided that no additional fees are charged to the consumer in connection therewith. The trader is also entitled to withdraw from the consumer contract if the consumer has not taken over the goods within 15 working days from the date the consumer was obliged to take over these goods.
10.2 The consumer may withdraw from a distance contract or from a contract concluded away from the trader's business premises within:
- a) 14 days from the day of receipt of the goods by the consumer or from the day of conclusion of the contract whose subject is the provision of a service,
- b) 30 days from the day of conclusion of the contract during an unsolicited visit or in connection therewith, or at a sales event or in connection therewith.
10.3 Goods are deemed to have been taken over by the consumer at the moment when the consumer or a third party designated by them, other than the carrier, takes over all parts of the ordered goods, or if:
- a) goods ordered by the consumer in one order are delivered separately, at the moment of taking over the goods that were delivered last,
- b) goods consisting of several parts or pieces are delivered, at the moment of taking over the last part or the last piece,
- c) goods are delivered repeatedly over a certain period, at the moment of taking over the first goods.
10.4 By sending the order to the trader, the consumer confirms that the trader has duly and timely fulfilled their information obligations pursuant to § 3(1) of the Consumer Protection Act in the sale of goods.
10.5 When exercising the right to withdraw from the contract, the consumer informs the trader of their decision to withdraw from this contract by an unambiguous declaration (for example, by letter sent by post, fax, or e-mail) to the trader's addresses stated above. For this purpose, the consumer may use the model withdrawal form that was sent to them together with the order confirmation and which is also an annex to these Terms and Conditions. The consumer may fill in and send the model withdrawal form or any other unambiguous declaration of withdrawal from the contract. The model form is available here.
10.6 Withdrawal from the consumer contract via the withdrawal form according to the preceding point of these General Terms and Conditions must contain the data required therein, in particular the exact specification of the goods, date of order, name and surname of the consumer(s), address of the consumer(s), signature of the consumer(s).
10.7 If the consumer withdraws from the contract, any ancillary contract related to the contract from which the consumer withdrew is also cancelled from the beginning; this does not apply if the parties expressly agree on the continuation of the ancillary contract.
10.8 The consumer may withdraw from the contract, the subject of which is the delivery of goods, even before the withdrawal period begins to run. The withdrawal period is deemed to be observed if the consumer sends the notice of withdrawal from the contract to the trader no later than the last day of the period.
10.9 The consumer may withdraw from the contract only in relation to a specific product or products, if the trader has delivered or provided several products under the consumer contract.
10.10 The consumer is obliged to send the goods back or hand over the goods to the trader at the trader's address within 14 days from the date of withdrawal from the consumer contract. The period according to the first sentence is deemed to be observed if the consumer sends the goods to the trader no later than the last day of the period. The trader does not accept cash on delivery shipments.
10.11 Upon withdrawal from the consumer contract, the consumer bears only the costs of returning the goods to the trader.
10.12 The consumer is liable for any reduction in the value of the goods that resulted from handling the goods beyond what is necessary to ascertain the properties and functionality of the goods.
10.13 After withdrawal from the contract, the trader shall refund to the consumer all payments that the consumer demonstrably made in connection with the contract, in particular the purchase price including the costs of transport, delivery, postage, and other costs and fees. The trader shall refund to the consumer all payments according to the preceding sentence to the extent corresponding to the withdrawal from the contract, if the consumer has not withdrawn from the entire contract. However, the trader is not obliged to reimburse the consumer for additional costs if the consumer chose a method of delivery other than the cheapest standard method of delivery offered by the trader. Additional costs shall mean the difference between the delivery costs chosen by the consumer and the costs of the cheapest standard method of delivery offered by the trader. Payments will be refunded to the consumer within 14 days from the date of receipt of the notice of withdrawal from the consumer contract. The refund will be made using the same method the consumer used for their payment. This does not affect the consumer's right to agree with the trader on another method of payment, provided that no additional fees are charged to the consumer in connection therewith. Instead of a refund, the consumer may, by agreement with the trader, choose other goods.
10.14 The trader is not obliged to refund all payments to the consumer under these General Terms and Conditions before the goods are delivered to them by the consumer or until the consumer proves that they have sent the goods back to the trader. The payment for the purchased goods will be made by the trader to the consumer only after the returned goods have been delivered back to the specified address of the trader or after the submission of a document proving the dispatch of the goods back, whichever occurs first. The period is deemed to be observed if the goods are sent back before the expiry of the 14-day period.
10.15 The trader is obliged to arrange for the collection of the goods at their own expense within the period according to these General Terms and Conditions, if under the consumer contract the goods were delivered to the consumer's home at the time of conclusion of the contract and, given the nature of the goods, it is not possible to send the goods back to the trader by post.
10.16 In the event that the consumer withdraws from the contract in accordance with these General Terms and Conditions and delivers to the trader goods that are used and are damaged or incomplete or the value of the goods in question is reduced as a result of handling the goods beyond what is necessary to ascertain the properties and functionality of the goods, the trader has a claim against the consumer for compensation for damage in the amount of the cost of repairing the goods and restoring the goods to their original condition, or the trader has the right to demand reimbursement from the consumer for the reduction in the value of the goods.
10.17 The consumer is obliged to send back or hand over the purchased goods together with accessories to the trader no later than 14 days from the date of withdrawal from the contract.
10.18 Upon withdrawal from the contract, the consumer bears the direct costs of returning the goods to the trader or to the person authorized by the trader to take over the goods, including the costs of returning goods that, due to their nature, cannot be returned by post. The direct costs associated with returning the goods cannot be reasonably calculated in advance. According to available information, the estimated expected amount of these costs, depending on the size and weight of the goods, the distance from which the goods are returned, and the prices at which the carrier chosen by the consumer provides its services, ranges from 2 EUR to 150 EUR.
10.19 If the consumer fails to fulfill any of the obligations set out in Articles 9 and 10 of these General Terms and Conditions, the withdrawal from the consumer contract is not valid and effective, and the trader is not obliged to refund all demonstrable payments under these General Terms and Conditions to the consumer, and at the same time is entitled to reimbursement of costs associated with sending the goods back to the consumer.
10.20 Repayment of a payment for a product made in cash upon withdrawal from the contract shall be rounded to 5 euro cents; the total remainder of the unrounded payment that is less than half the value of 5 euro cents shall be rounded down, and the total remainder of the unrounded payment that is equal to or greater than half the value of 5 euro cents shall be rounded up. If the payment according to the first sentence is the sum of prices for several products, only the final payment is rounded. A payment of 1 euro cent or 2 euro cents shall be rounded to 5 euro cents.
10.21 The consumer may not withdraw from a contract the subject of which is:
- a) the provision of a service, if 1. the service has been fully provided and 2. the provision of the service began before the expiry of the withdrawal period with the consumer's express consent and the consumer declared that they have been duly informed that by giving consent they lose the right to withdraw from the contract after the full provision of the service, if under the contract the consumer is obliged to pay the price,
- b) the delivery or provision of a product whose price depends on movements in the financial market which the trader cannot influence and which may occur during the withdrawal period,
- c) the delivery of goods manufactured according to the consumer's specifications or goods made to measure,
- d) the sale of goods that are subject to rapid deterioration in quality or spoilage,
- e) the sale of goods sealed in protective packaging that are not suitable for return for health or hygiene reasons and whose protective packaging has been breached after delivery,
- f) the sale of goods which, by their nature, after delivery become inseparably mixed with other goods,
- g) the sale of alcoholic beverages, the price of which was agreed at the time of conclusion of the contract, the delivery of which can take place no earlier than 30 days, and the price of which depends on market fluctuations which the trader cannot influence,
- h) the execution of urgent repairs or maintenance during a visit to the consumer, which the consumer expressly requested from the trader; this does not apply to a contract whose subject is the provision of a service other than repair or maintenance, and to a contract whose subject is the delivery of goods other than a spare part necessary for carrying out the repair or maintenance, if the contracts were concluded during the trader's visit to the consumer and the consumer did not pre-order these goods or services,
- i) the delivery of sound recordings, image recordings, audiovisual recordings, or software in protective packaging that has been breached after delivery,
- j) the delivery of periodical press, except for its delivery under a subscription contract,
- k) goods purchased at a public auction,
- l) the provision of accommodation services for purposes other than habitation, transport of goods, car rental, provision of catering services, or provision of services related to leisure activities, if under the contract the trader is to provide these services at a precisely agreed time or within a precisely agreed period,
- m) the delivery of digital content delivered by the trader otherwise than on a tangible medium, if 1. the supply of digital content has begun and 2. the consumer has given express consent to the commencement of the supply of digital content before the expiry of the withdrawal period, declared that they have been duly informed that by giving consent they lose the right to withdraw from the contract upon the commencement of the supply of digital content, and the trader has provided the consumer with confirmation pursuant to § 17(12)(b) or (13)(b) of the Consumer Protection Act, if under the contract the consumer is obliged to pay the price.
10.22 When issuing a credit note, the consumer may be required to present a valid identity card for inspection for the purpose of protecting the consumer's property rights and identification. By presenting the identity card for inspection, the consumer consents to the processing of personal data in accordance with Act No. 18/2018 Coll. on the Protection of Personal Data, as amended, stated on the identity card, for the duration of the inspection thereof.
10.23 The trader reserves the right to cancel the order or part thereof if it is not possible for technical reasons to deliver the goods within the required period, the goods are no longer supplied or manufactured, or the price has changed significantly on the part of the supplier (manufacturer) of the goods. If this situation occurs, the trader will immediately contact the consumer for the purpose of agreeing on further procedure. If the consumer has paid a deposit, it will be immediately transferred back to their account or address. In the case of cancellation of the order, contact the seller.
10.24 If the consumer does not use the option to withdraw from the contract in accordance with these General Terms and Conditions and does not take over the delivered goods sent cash on delivery at the relevant delivery post office or from the courier, i.e., these goods are returned to the trader, the contract is thereby cancelled from the outset, and the consumer is obliged to reimburse the trader for the resulting compensation for damage and all related costs (e.g., costs of sending the goods and their return, postage, packaging, etc.).
11. Personal Data and Their Protection
11.1 The trader has adopted reasonable technical, organizational, and personnel measures corresponding to the method of processing personal data, taking into account in particular the applicable technical means, the confidentiality and importance of the processed personal data, as well as the extent of possible risks that are capable of compromising the security or functionality of its information systems in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and Act No. 18/2018 Coll. on the Protection of Personal Data. The consumer consents to the processing of their personal data in accordance with these rules (clicking here will display the Privacy Policy).
12. Alternative Dispute Resolution
12.1 If the consumer was not satisfied with the handling of a complaint by the trader or when the consumer contacted the trader with a request for redress and was not satisfied with the manner in which the trader handled their complaint, or if they believe that the trader has violated their rights, the consumer has the right to contact the trader with a request for redress. If the trader responds to such a request negatively or does not respond to it within 30 days from the date of its sending, the consumer has the right to submit a proposal to initiate alternative dispute resolution to an alternative dispute resolution entity. The competent entity for alternative resolution of consumer disputes with the trader is:
- a) Slovak Trade Inspection (SOI) SOI Inspectorate for the Žilina Region, Predmestská 71, 011 79, Žilina, tel. no. 041 / 763 21 30
- b) or another relevant authorized legal entity registered in the list of alternative dispute resolution entities maintained by the Ministry of Economy of the Slovak Republic (the list is available at https://www.mhsr.sk/obchod/ochrana-spotrebitela/alternativne-riesenie-spotrebitelskych-sporov-1/zoznam-subjektov-alternativneho-riesenia-spotrebitelskych-sporov-1).
12.2 The consumer has the right to choose which of the aforementioned alternative consumer dispute resolution entities to contact.
12.3 Alternative dispute resolution concerns only disputes between the consumer and the trader arising from or related to a consumer contract. Alternative dispute resolution concerns only contracts concluded at a distance. Alternative dispute resolution does not concern disputes where the value of the dispute does not exceed 20 EUR. The ADR entity may require the consumer to pay a fee for initiating alternative dispute resolution of a maximum amount of 5 EUR including VAT.
13. Product Reviews
13.1 The trader reserves the right not to publish reviews for goods that contain inappropriate expressions, are false, are not related to the given product, refer to external websites, or in any other way damage the name of the trader.
13.2 The trader ensures that product ratings on its website, which it sells, come from consumers who have actually purchased or used the product. A product rating may only be provided by a consumer who has actually purchased the given product or service from the seller.
14. Gift Vouchers (Certificates)
14.1 Gift vouchers (certificates) issued by the trader may be used for the purchase of goods on the trader's e-commerce website. Unless stated otherwise, the gift voucher may only be used for the purchase of goods, does not apply to services, postage costs, and other fees.
14.2 The value of the gift voucher is stated on each voucher as an amount including VAT, whereby the voucher functions as a discount on the total amount of the ordered goods including VAT. The gift voucher can only be used for its full value within a single purchase; it cannot be applied in parts. Any underpayment for the purchase of goods must be paid in monetary form; any overpayment will not be refunded.
14.3 The gift voucher cannot be exchanged for cash. If the consumer is entitled to withdraw from the purchase contract for the purchase of goods for which the consumer paid with a gift voucher, the consumer becomes entitled to a refund of the purchase price in the form of a gift voucher (by sending a gift voucher to the address provided by the consumer).
15. Consumer Promotion and Loyalty Program
15.1 If the consumer participates in a consumer promotion, whether through the purchase of a product to which they receive a gift or an additional product at a discounted price, they agree with the conditions of this promotion, which are always presented in a visible manner on the website of the trader's online store. The consumer further expressly agrees that if they lack full legal capacity, their entitlement to the issuance of a gift or additional product provided at a discounted price shall lapse (in this case, the purchase contract for the additional product shall not be concluded) if such gift or additional product provided at a discounted price is an alcoholic beverage, tobacco product, or other similar product, or a product or item that is not suitable for persons under 18 years of age.
15.2 If the consumer participates in a consumer promotion, campaign, or other similar event (hereinafter referred to as "promotion"), the principle of which is obtaining a gift with a purchase, which serves as a reward for participation in the promotion, or possibly as a prize in the promotion, this gift (or prize) is not the subject of the purchase contract and the consumer thus does not have rights arising from liability for defects and failures concerning the obtained gift item. On this basis, the trader does not provide a warranty for the gift.
15.3 The trader is entitled to organize consumer promotions in which the consumer is included in the promotion based on a previous completed transaction. If the consumer purchases goods of a certain predetermined value, they will receive from the trader a discount voucher for a subsequent purchase of a value determined by the trader, via an e-mail message (commercial communication). The exact rules with specific information are published by the trader in advance on the websites of the trader's online store.
15.4 The trader has established a Loyalty Program, which any consumer may join if they meet the internal requirements for inclusion in the Loyalty Program. The trader shall inform the consumer of this fact via an e-mail message (commercial communication).
16. Final Provisions
16.1 These General Terms and Conditions take effect as of 07.07.2026.
16.2 The trader reserves the right to amend these General Terms and Conditions. The obligation to notify changes in these General Terms and Conditions in writing is fulfilled by placing them on the trader's e-commerce website. However, a validly concluded contract is governed by the General Terms and Conditions in force at the time it was concluded.
16.3 If the consumer contract is concluded in writing, any amendment thereto must be in writing.
16.4 The parties have agreed that communication between them shall take place mainly in the form of e-mail messages or by postal mail.
16.5 Relations not regulated by these General Terms and Conditions are governed by the relevant provisions of Act No. 40/1964 Coll., the Civil Code, Act No. 108/2024 Coll. on Consumer Protection and on Amendments and Supplements to Certain Acts, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), and Act No. 18/2018 Coll. on the Protection of Personal Data.
16.6 These General Terms and Conditions become effective with respect to the consumer upon sending the electronic order by the consumer.
16.7 By ticking the box before sending the order, the consumer confirms that they have read and fully agree with these General Terms and Conditions.
Part II. Terms and Conditions for Persons Who Are Not Consumers

1.4 For the purposes of these Terms and Conditions, an entrepreneur means a person registered in the Commercial Register; a person conducting business based on a trade license; a person conducting business based on a license other than a trade license under special regulations; a natural person who carries out agricultural production and is registered in the registry according to a special regulation.

1.6 The buyer – entrepreneur acknowledges that the warranty conditions as well as the complaint procedure itself regulated in these Terms and Conditions Part II may differ from those in Terms and Conditions Part I for consumers.
1.7 The parties have agreed that by sending the order to the seller, the buyer confirms that they agree that these General Terms and Conditions and their conditions and provisions shall apply to all purchase contracts concluded on any e-commerce website operated by the seller, under which the seller delivers goods presented on the relevant website to the buyer (hereinafter referred to as the "purchase contract") and to all relations between the seller and the buyer, arising in particular from the conclusion of the purchase contract and the complaint of goods.
1.8 The General Terms and Conditions form an integral part of the purchase contract. If the seller and the buyer enter into a written purchase contract stipulating conditions different from the General Terms and Conditions, the provisions of the purchase contract shall take precedence over the General Terms and Conditions.
1.9 Legal relations of the seller with the buyer who is an entrepreneur, not expressly regulated by these General Terms and Conditions or the framework agreement between the seller and the buyer, are governed by the relevant provisions of the Commercial Code.
1.10 The list of goods on any e-commerce website operated by the seller is a catalogue of commonly supplied goods, and the seller does not guarantee the immediate availability of all listed goods. The availability of goods will be confirmed to the buyer based on the buyer's query.
2. Method of Concluding a Purchase Contract
2.1 A purchase contract is concluded by the binding acceptance of the buyer's proposal to conclude a purchase contract by the seller in the form of an e-mail message from the buyer sent to the seller and/or in the form of a form completed and sent by the buyer on the seller's website and/or in the form of a telephone order by the buyer to the seller (hereinafter referred to as the "order").
2.2 The binding acceptance of the buyer's order by the seller is the e-mail confirmation by the seller to the buyer of the acceptance of the order after prior receipt of the order by the buyer and after verification of the availability of the goods, current prices, and delivery date of the goods requested by the buyer, marked as "order confirmation". In the event of finding a higher price, the seller has the obligation to obtain the customer's consent to the price change according to the current price list before confirming the order. Only upon the customer's consent to the price change and subsequent confirmation (acceptance) of the order by the seller shall the contractual relationship be deemed concluded. All prices for goods and services and all fees in the online store are stated including VAT. All further information regarding their order will be sent to the buyer's e-mail address if necessary.
2.3 The binding acceptance of the order contains in particular the data on the name and specification of the goods whose sale is the subject of the purchase contract, further data on the price of the goods and/or other services, data on the delivery time of the goods, the name and data on the place where the goods are to be delivered, and data on the price, conditions, method, and date of transport of the goods to the agreed place of delivery of the goods for the buyer, data on the seller (business name, registered office, ID No., commercial register entry number, etc.), possibly other data.
2.4 The buyer may deliver to the seller, by electronic mail or telephone, within 24 hours of the order being received by the seller, a notice that they are cancelling the order. The buyer is obliged to state in the notice of cancellation the name, e-mail, and description of the ordered goods. In the case of cancellation of the order, the seller does not charge the buyer any fees related to the cancellation of the order. If the buyer has paid the purchase price or part thereof to the seller at the time of cancellation of the order, the seller shall refund the already paid purchase price or part thereof within 14 days of the cancellation of the order by transfer to the buyer's bank account, unless the parties agree on another method of refunding the purchase price.
2.5 According to the amendment to Act No. 222/2004 Coll. on Value Added Tax, the data in an already issued tax document (invoice) cannot be changed. Data in the tax document (invoice) can only be changed if the customer has not yet received and paid for the goods.
2.6 In the case of ongoing promotions, the sale of goods on the seller's website is governed, in addition to these General Terms and Conditions, also by the binding conditions of the relevant promotion. If the buyer orders goods in violation of the conditions of the relevant promotion, the seller is entitled to cancel the buyer's order. The customer will be informed of the cancellation via e-mail, and in the event of payment of the purchase price or part thereof, the funds will be returned within 14 days to the account designated by them, unless agreed otherwise with the seller.
3. Rights and Obligations of the Seller
3.1 The seller is obliged to:
- a) deliver to the buyer, on the basis of an order confirmed by the seller, the goods in the agreed quantity, quality, and

3.2 The seller has the right to proper and timely payment of the purchase price from the buyer for the delivered goods.
3.3 The seller has the right to cancel the order if, due to stock depletion or unavailability of goods, they are unable to deliver the goods to the buyer within the period specified by these Terms and Conditions or at the price stated in the online store, unless they agree with the customer on alternative performance. The customer will be informed of the cancellation of the order by phone or e-mail, and in the event of payment of the purchase price or part thereof, the funds will be returned within 14 days to the account designated by them, unless agreed otherwise with the seller.
3.4 The trader's company reserves the right to verify the identity of the buyer or the person authorized to collect the goods during personal collection of the goods, in cases where the delivery of the goods is prepaid by the buyer by card, bank transfer, or by invoice with a due date.
4. Rights and Obligations of the Buyer
4.1 The buyer is obliged to:
- a) take over the purchased or ordered goods,
- b) pay the seller the agreed purchase price within the agreed due date, including the costs of delivery of the goods,

- d) confirm the receipt of the goods in the delivery note by their signature or the signature of a person authorized by them.
4.2 The buyer has the right to delivery of the goods in the quantity, quality, time, and place agreed by the parties in the binding acceptance of the order.
5. Delivery and Payment Terms
5.1 The seller delivers goods only within the Slovak Republic. A buyer from another Member State of the European Union may, by agreement with the seller, pick up the ordered goods at the seller's address stated above, or by agreement with the seller, the goods may be delivered to a place designated by the buyer within the Slovak Republic.
5.2 Goods are sold according to the exhibited samples, catalogues, type sheets, and sample books of the seller placed on the seller's e-commerce website. The delivered goods have a minimum durability period of more than 2 months before the use-by date. In the case of a shorter durability period, the seller shall contact the buyer by phone or e-mail before delivery and shall deliver the goods only after the buyer's consent.
5.3 The seller is obliged to fulfill the buyer's order and deliver the goods to the buyer within 30 days of acceptance of the buyer's order by the seller; the buyer accepts this delivery period without objection. Delivery of the Goods is carried out by the Seller using courier services of third parties, on working days from 8:00 a.m. to 5:00 p.m.
5.4 The seller states the options for delivery of Goods and the fees for these individual options for delivery of Goods.
5.5 The buyer is obliged to take over the goods at the place stated in the acceptance of the buyer's order by the seller. If the buyer, without prior written withdrawal from the contract, does not take over the goods within five working days after the expiry of the period stated in the purchase contract, binding acceptance, the seller is entitled to claim compensation for the resulting damage in the amount of actual costs for the attempt at unsuccessful delivery of the order. After the expiry of five working days from the date the buyer was obliged to take over the goods, the seller is entitled to withdraw from the purchase contract and sell the goods to a third party.
5.6 The seller is entitled to invite the buyer to take over the goods before the expiry of the period agreed in the purchase contract.
5.7 The weight, dimensions, and other data about the goods contained in catalogues, brochures, and other documents of the seller provided by the manufacturer may differ from the actual data by ± 3% of the stated value.
5.8 The place of delivery of the goods is the place stated in the acceptance of the order by the seller, unless the parties agree otherwise in the purchase contract.
5.9 If the seller transports the goods to the buyer at the place designated in the purchase contract by the buyer, the buyer is obliged to take over the goods in person or to ensure that the goods are taken over by a person authorized by them for the case of their absence for receipt of the goods stated in the purchase contract and to sign the protocol of delivery and handover of the goods. The third person authorized to take over the goods stated in the purchase contract is obliged to present to the seller the original or a copy of the purchase contract and proof of payment for the goods and a written authorization. If it is necessary to repeat the delivery of the goods due to the absence of the buyer at the place designated in the purchase contract, all costs incurred thereby shall be borne by the buyer, in particular the repeated delivery of the goods to the place of destination in the purchase contract.
5.10 The buyer is entitled to inspect the shipment, i.e., the goods as well as their packaging, immediately after delivery in the presence of the seller's representative. In the event of finding a defect in the goods and/or if the shipment is incomplete (lower number of pieces of goods, or ordered goods are missing), the seller's representative is obliged, at the buyer's request, to enable the buyer to draw up a record – Damage Report – stating the extent and nature of the defect in the goods, the correctness of which shall be confirmed by the buyer and the seller's representative. Based on such a record delivered to the seller, the buyer may subsequently refuse to take over the delivered defective goods or confirm the delivery of defective goods and subsequently, in accordance with Art. 8 of these Terms and Conditions and Complaint Procedure, file a complaint about the defects of the goods with the seller or an authorized person. If the buyer refuses to take over the delivered defective goods, all reasonably incurred costs of returning the goods to the seller shall be borne by the seller.
5.11 When a shipment is delivered by a transport company in the event of finding a breached or damaged package, damage with loss of content, we recommend not accepting the shipment, or resolving it directly with the employee of the transport company or with the employee at the counter of the given post office on site by drawing up a damage report. In the event of acceptance and discovery of a breached or damaged package, damage with loss of content, we ask you to report this event no later than 24 hours from receipt of the shipment to the seller's e-mail address. The damaged product, the shipment packaging, the shipment receipt document, and the acquisition document – invoice – are required for drawing up the damage report.
5.12 Complaints about mechanical damage to the product that was not apparent upon receipt of the shipment must be filed immediately after receipt of the shipment, but no later than 24 hours from delivery of the goods. It is the customer's duty to prove that the mechanical damage could not be discovered even upon thorough inspection of the product and its packaging according to point 5.10. Later complaints about mechanical damage to the product cannot be recognized. Before first use, the buyer is obliged to read the warranty conditions.
5.13 The customer is obliged to check the completeness of the packaging upon receipt of the product (in person or non-personally). When delivered by courier, the buyer must draw up a damage report on site about the incompleteness of the packaging. When collecting in person, the buyer is obliged to check the contents of the packaging immediately; subsequent complaints will not be accepted.
5.14 In the event of non-delivery of the goods by the seller within the period specified in 5.3 of the Terms and Conditions, the buyer is entitled to withdraw from the purchase contract, and the seller is obliged to refund the already paid part of the purchase price to the buyer without undue delay, but no later than 14 days from receipt of the withdrawal from the purchase contract, using the same method the buyer used for their payment, unless they agree with the buyer on another method of return without the buyer being charged any additional fees.
5.15 The buyer will receive an invoice by e-mail with each shipment.
5.16 Methods of payment:
- a) payment card (CardPay),
- b) internet banking payment gateway,
- c) bank transfer or deposit to the seller's account on the basis of a proforma invoice issued by the trader,
- d) cash on delivery (payment to the delivery intermediary upon receipt of goods),
- e) gift vouchers.
6. Purchase Price
6.1 The buyer is obliged to pay the seller the purchase price of the goods agreed in the purchase contract and/or according to the seller's price list valid at the time of conclusion of the purchase contract, including the costs of delivery of the goods (hereinafter referred to as the "purchase price"). All prices stated on the seller's website are final. The price of the goods does not include the cost of transport and packaging. Possible costs for transport and packaging will be charged at the end of the order. For the goods, the buyer pays the price stated on the seller's website at the time of placing the order. Individual discounts to buyers are subject to a separate agreement.
6.2 If the buyer pays the purchase price to the seller by cashless transfer, the day of payment is considered to be the day on which the full purchase price is credited to the seller's account.
6.3 The buyer is obliged to pay the seller the purchase price for the agreed goods within the period according to the purchase contract, but no later than upon receipt of the goods.
6.4 If the buyer pays the seller the purchase price for the goods agreed in the purchase contract, the buyer is entitled to withdraw from the purchase contract and demand a refund of the purchase price only in accordance with the valid legal regulations of the Slovak Republic.
6.5 Costs associated with carrying out the goods are not included in the purchase price of the goods, and the seller is not obliged to provide these services to the buyer.
6.6 All promotions are valid while stocks last, unless stated otherwise for a specific product.
6.7 If the purchase price for returned or complained goods and goods for which withdrawal from the contract has occurred is paid by the buyer in the form of gift certificates, or possibly their combination with monetary payment, the seller shall refund the purchase price to the buyer in the same form as it was paid by the buyer. However, the value of the returned gift certificates to the buyer must not exceed the value of the gift certificates paid by the buyer when purchasing the goods. If the return of gift certificates is not possible for objective reasons, in particular because the seller does not have gift certificates of the required amount available, the seller shall provide monetary compensation to the buyer.
6.8 No goods of the seller are intended for industrial or professional use. The seller's goods are not intended for resale. If the buyer orders or purchases a quantity that does not correspond to normal household use or normal operation of an entrepreneur's establishment, or if the seller deems that such goods will be used for resale, the seller is entitled to cancel the order, and if the order was confirmed, is entitled to withdraw from the purchase contract, without any further claims of the buyer.
7. Acquisition of Ownership and Passing of Risk of Damage to Goods
7.1 The goods remain the property of the seller until the full payment of the purchase price by the buyer. Goods are deemed delivered upon taking over the goods in person or at the moment of their collection by the transport company.
7.2 The risk of damage to the goods passes to the buyer at the time when they take over the goods from the seller, or if they do not do so in time, at the time when the seller enables them to dispose of the goods and the buyer does not take them over.
8. Complaint Procedure (Liability for Defects, Warranty, Complaints)
8.1 The seller is liable for defects of the goods. The buyer who is an entrepreneur is obliged to file a complaint without undue delay.
8.2 The handling of complaints is subject to the valid Complaint Procedure, in those parts concerning entrepreneurs. Should the provisions of the Complaint Procedure, published on the seller's website kvalitne-vino.eu, conflict with the provisions of this Complaint Procedure under these Terms and Conditions for Entrepreneurs, the provisions under these Terms and Conditions for Entrepreneurs shall apply to the entrepreneur's complaint. By ticking the box before sending the order to the seller, the buyer confirms that they have read and fully agree with the Complaint Procedure, and at the same time confirms that they have been properly informed about the conditions and method of complaining about the goods, including information on where the complaint can be filed.
8.3 The Complaint Procedure applies to goods purchased by the buyer from the seller in the form of e-commerce on the seller's e-commerce website.
8.4 The Complaint Procedure in this form is valid for all business cases, unless other warranty conditions are contractually agreed.
8.5 The buyer has the right to assert during the warranty period with the seller liability for defects of goods that shows defects for which the manufacturer, supplier, or seller is responsible.
8.6 The buyer is obliged to inspect the goods upon receipt. If they do not do so, they may only assert claims for defects discovered during this inspection if they prove that these defects were present in the goods at the time of receipt.
8.7 During the warranty period, the customer has the right to free removal of the defect after presenting the goods including accessories, documentation to the authorized representative of the seller, and a proof of payment.
8.8 If the goods show defects, the customer has the right to file a complaint at the seller's address stated in these Terms and Conditions by delivering the goods including accessories to the address Glados, s.r.o., Langov Dvor 20, 03861, Vrútky and filling out a complaint form and delivering it to the seller. The form shall be determined by the seller and its template shall be placed on the seller's website. The customer is obliged to precisely state in the form the type and extent of the defects of the goods, as well as the time of discovery of the defect. The complaint procedure for goods that can be objectively delivered to the seller begins on the day when all of the following conditions are met:
- a) delivery of the completed complaint form from the buyer to the seller,
- b) delivery of the complained goods from the buyer to the seller.
8.9 The seller recommends that the buyer insure the shipment with the goods. The seller does not accept goods sent cash on delivery. The start of the complaint procedure is also the day of filing the complaint. The complained goods must be delivered to the seller's registered office, unless the seller or an authorized person determines otherwise (e.g., deliver the goods directly to the authorized person). In case of any uncertainty, please contact the trader's company.
8.10 The buyer is obliged to complain about defects of the goods to the seller without undue delay, otherwise the buyer's right to free removal of the defect against the seller lapses.
8.11 The 30-day period pursuant to the Consumer Protection Act does not apply to the handling of complaints by a buyer who is an entrepreneur. The period for handling complaints for entrepreneurs is not regulated by law, however, our company undertakes to handle complaints of entrepreneurs within the meaning of these Terms and Conditions within 60 days.
8.12 The buyer has no right to assert a warranty for defects that the seller drew attention to at the time of concluding the contract, or that the buyer must have been aware of given the circumstances under which the purchase contract was concluded.
8.13 The seller may always replace the defective item with a defect-free one instead of remedying the defect, if this does not cause the buyer significant difficulties.
8.14 The right to assert a warranty with the seller by the buyer lapses:
- a) by failure to present a proof of payment, accessories, or documentation of the goods,
- b) by failure to report obvious defects upon receipt of the goods,
- c) by expiry of the warranty period of the goods,
- d) by mechanical damage to the goods caused by the buyer,
- e) by using the goods in conditions that do not correspond, in terms of humidity, chemical and mechanical influences, to the natural environment,
- f) by unprofessional handling, operation, or neglect of care for the goods,
- g) by damage to the goods due to excessive loading or use contrary to the conditions stated in the documentation, general principles, technical standards, or safety regulations in force in the Slovak Republic,
- h) by damage to the goods due to unavoidable and/or unforeseeable events,
- i) by damage to the goods due to accidental destruction and accidental deterioration,
- j) by unprofessional intervention, damage during transport, damage by water, fire, static or atmospheric electricity, or other force majeure intervention,
- k) by interference with the goods by a person not authorized thereto.
8.15 The warranty does not apply to normal wear and tear of the item (or its parts) caused by use. A shorter lifespan of the product cannot therefore be considered a defect and cannot be complained about either.
8.16 If the goods upon receipt by the buyer are not in conformity with the purchase contract (so-called non-conformity with the purchase contract), the buyer has the right to have the seller, free of charge and without undue delay, bring the item into a state conforming to the purchase contract, according to the buyer's requirements either by replacement of the goods or by repair thereof. If such a procedure is not possible, the buyer may demand a reasonable discount on the price of the goods or withdraw from the contract. This does not apply if the buyer knew about the non-conformity with the purchase contract before receiving the goods or caused the non-conformity with the purchase contract themselves. Non-conformity with the purchase contract that becomes apparent within six months from the day of receipt of the goods is deemed to have existed at the time of receipt, unless this is contrary to the nature of the goods or unless proven otherwise. In the case of non-conformity of the goods with the contract, the entrepreneur is entitled to so-called remedy, namely:
- a) free restoration of the consumer goods to a state conforming to the contract through repair,
- b) reasonable reduction of the purchase price,
- c) substitute delivery of goods,
- d) withdrawal from the contract.
8.17 The seller is obliged to handle the complaint and conclude the complaint procedure in one of the following ways:
- a) handing over the repaired goods,
- b) replacement of goods,
- c) replacement of goods,
- d) refund of the purchase price of the goods,
- e) payment of a reasonable discount on the price of the goods,
- f) written invitation to take over the performance designated by the seller,
- g) justified rejection of the complaint of goods.
8.18 The warranty period is 12 months (unless a different warranty period is established for specific cases) and begins to run from the day of receipt of the goods by the buyer. The warranty period is governed by the manufacturer's warranty conditions in accordance with the relevant conditions under the Commercial Code (§ 429 et seq.). For selected products, the warranty is limited by the manufacturer for buyers.
8.19 The warranty period published in the product catalogue on the website kvalitne-vino.eu is published in accordance with the Civil Code and has no relation to entrepreneurs and therefore does not apply to these General Terms and Conditions.
8.20 In the case of replacement of the goods with new ones, the buyer shall receive a document stating the replaced goods, and any further complaints shall be made on the basis of the originally issued invoice and this complaint document. In the case of replacement of the goods with new ones, the warranty period shall begin to run anew from the receipt of the new goods, but only for the new goods.
8.21 Firstly, the customer may demand from the seller a free substitute delivery of consumer goods. The buyer has the right to replacement of goods only if it is not disproportionate given the nature of the defect. Whether the defect is proportionate shall be decided by the seller in the form of a written assessment of this defect. Based on this decision, further action shall be taken according to the law.
8.22 If it is a defect that can be remedied, the goods will be repaired. If repair is not possible and the nature of the defect does not prevent normal use, the seller may agree with the buyer on a reasonable discount on the price of the goods. In the case of a discount, this defect cannot be complained about later.
8.23 If it is a defect that cannot be remedied and which prevents the item from being properly used as an item without defects, the seller is entitled to exchange the defective goods for goods with the same or similar utility properties or issue a credit note.
8.24 If the delivery of defective goods constitutes a material breach of contract, the buyer may:
- a) demand removal of defects by delivery of replacement goods for the defective goods, delivery of missing goods, and demand
- b) removal of legal defects,
- c) demand removal of defects by repair of the goods, if the defects are repairable,
- d) demand a reasonable discount on the purchase price or withdraw from the contract.
8.25 The buyer is entitled to choose between the claims set out in 8.24 only if they notify the seller thereof in a timely notice of defects or without undue delay after such notice. The buyer may not change the chosen claim without the seller's consent. However, if it turns out that the defects of the goods are irreparable or that their repair would involve disproportionate costs, the buyer may demand delivery of replacement goods if they request this from the seller without undue delay after the seller has notified them of this fact. If the seller does not remedy the defects of the goods within a reasonable additional period or if they notify before its expiry that they will not remedy the defects, the buyer may withdraw from the contract or demand a reasonable discount on the purchase price.
8.26 If the buyer does not notify the choice of their claim within the period stated in point 8.25, they have claims for defects of the goods as in the case of a non-material breach of contract.
8.27 If the delivery of defective goods constitutes a non-material breach of contract, the buyer may demand either delivery of the missing goods and removal of other defects of the goods, or a discount on the purchase price.
8.28 Until the buyer asserts a claim for a discount on the purchase price or withdraws from the contract, the seller is obliged to deliver the missing goods and remove legal defects of the goods. The seller is obliged to remove other defects according to their choice by repair of the goods or delivery of replacement goods; however, the chosen method of removing defects must not cause the buyer to incur disproportionate costs.
8.29 If the buyer demands removal of defects of the goods, they may not, before the expiry of an additional reasonable period which they are obliged to provide to the seller for this purpose, assert other claims from defects of the goods, except for a claim for damages and a contractual penalty, unless the seller notifies the buyer that they will not fulfill their obligations within this period. This period must be determined in accordance with point 8.11 of these Terms and Conditions for Entrepreneurs.
8.30 Until the buyer specifies the period according to point 8.25 or asserts a claim for a discount on the purchase price, the seller may notify the buyer that they will remedy the defects within a certain period. If the buyer, without undue delay after receiving this notification, does not notify the seller of their disagreement, this notification has the effect of specifying the period according to paragraph 8.25.
8.31 If the seller does not remedy the defects of the goods within the period resulting from point 8.25 or 8.26, the buyer may assert a claim for a discount on the purchase price or withdraw from the contract, if they warn the seller of their intention to withdraw from the contract when specifying the period according to point 8.25 or within a reasonable period before withdrawal from the contract. The buyer may not change the chosen claim without the seller's consent.
8.32 For the purposes of these Terms and Conditions, a breach of contract is material if the breaching party knew at the time of conclusion of the contract or it was reasonable to foresee at that time, taking into account the purpose of the contract which resulted from its content or from the circumstances under which the contract was concluded, that the other party would have no interest in the performance of obligations in the event of such a breach of contract. In case of doubt, it is presumed that the breach of contract is not material.
8.33 The handling of a complaint relates only to the defects stated in the complaint form.
8.34 The buyer's entitlement to file a complaint about a defect of the goods is exhausted after they have exercised their right and requested the seller to remove the defect of the goods according to these complaint and terms and conditions, and regardless of the outcome of the complaint, they are no longer entitled to file a complaint repeatedly for the same unique defect (not a defect of the same type).
8.35 If the seller concludes the complaint procedure as a justified rejection of the complaint, but the defect of the product objectively exists and has not been remedied, the buyer may assert their right to have the defect of the goods remedied through court.
8.36 The buyer is obliged to collect the goods no later than 60 days from the conclusion of the complaint. If they fail to do so, they are obliged to pay a storage fee of 1 EUR for each day of delay in taking over the goods. If the buyer does not collect the goods within six months from the date they were obliged to collect them, the seller has the right to sell the goods to a third party or dispose of them in an appropriate manner. If the goods are sold, the seller shall pay the buyer the proceeds of the sale after deducting the storage fee and costs of sale.
9. Withdrawal from the Purchase Contract
9.1 The seller is entitled to withdraw from the purchase contract due to stock depletion, unavailability of goods, or if the manufacturer, importer, or supplier of the goods agreed in the purchase contract has discontinued production or made such significant changes that prevented the fulfillment of the seller's obligations arising from the purchase contract, or due to force majeure, or if even after exerting all efforts that can be reasonably required of them, they are unable to deliver the goods to the customer within the period specified by these Terms and Conditions or at the price stated in the online store. The seller is obliged to immediately inform the buyer of this fact and refund the already paid deposit for the goods agreed in the purchase contract within 14 days from the notification of withdrawal from the contract, by transfer to the account designated by the buyer, unless the parties agree otherwise. The seller is also entitled to withdraw from the purchase contract if the buyer has not taken over the goods within five working days from the date the buyer was obliged to take over these goods. The seller is further entitled to withdraw from the contract concluded with a customer in the event of an obvious error in the price of the goods (i.e., a price clearly different from the price usual for this type/kind of goods). An obvious error in the price of the goods is considered to be, for example, erroneously stating the first three digits instead of four; a price lower by one digit (e.g., one digit "falls out" when stating the price); a clearly low price of the goods (e.g., a price 50% lower than is usual for this type and kind of goods, without it being stated that the goods are on sale or at another discount promotion); and other obvious writing errors, obvious errors in the description of the goods, picture, etc., or in the case of an obviously erroneous information provided by the customer centre operator. If this situation occurs, the seller will immediately contact the buyer for the purpose of agreeing on further procedure. If the buyer has already paid part or all of the purchase price, this amount shall be returned to them within 14 days of notification of withdrawal from the contract by transfer to the account designated by the buyer, unless the parties agree otherwise. The seller is entitled to withdraw from the purchase contract also for any other reason permitted by the Commercial Code.
9.2 A buyer who is an entrepreneur may withdraw from the purchase contract within a 14-day period without giving a reason if the goods are unopened and undamaged. The declared condition "unopened and undamaged" shall be assessed by the seller, and based on this they shall decide on the withdrawal from the contract.
9.3 A buyer who is an entrepreneur may be offered an alternative withdrawal from the purchase contract depending on the condition of the returned goods, lost warranty, and current price of the returned goods. The condition of the goods will be assessed by the seller. In the event that conditions acceptable to both parties are not agreed, the goods will be returned at the seller's expense. The seller is entitled to charge the buyer for any additional costs incurred. The seller reserves the right to disallow withdrawal, given the nature of the product and its condition at the time of return.
9.4 The buyer asserts their right to withdraw from the contract with the seller in writing.
9.5 Upon withdrawal from the purchase contract, the buyer is obliged to deliver the goods to the seller together with accessories including documentation, proof of payment, etc., and in the original packaging, by sending them to the trader's address. We recommend insuring the goods.
9.6 If the buyer withdraws from the contract, any ancillary contract related to the contract from which the buyer withdrew is also cancelled from the beginning.
9.7 The buyer may withdraw from the contract, the subject of which is the delivery of goods, even before the withdrawal period begins to run. The withdrawal period is deemed to be observed if the buyer sends the notice of exercising the right to withdraw from the contract before the withdrawal period expires.
9.8 After withdrawal from the contract, the seller shall refund to the buyer the purchase price or part thereof that the buyer demonstrably paid in connection with the conclusion of the contract, or the procedure according to point 6.7 of these General Terms and Conditions shall be followed by sending a gift certificate to the buyer's address. The purchase price will be refunded to the buyer after receipt of the goods from the buyer. The seller shall refund the purchase price or part thereof by payment to the buyer's bank account, or by postal money order to the buyer's registered office.
9.9 The seller is not obliged to refund the purchase price or part thereof to the buyer, according to point 9.8 of these General Terms and Conditions, before the goods are delivered to them by the buyer. The payment for the purchased goods will therefore be made by the seller to the buyer only after the returned goods have been delivered back to the address stated in point 9.5 of these General Terms and Conditions.
9.10 In the case of withdrawal from the contract, the buyer is obliged to deliver or hand over to the seller the goods together with accessories including documentation, proof of payment, etc., and in the original packaging, no later than 14 days from the date of conclusion of the purchase contract. For a valid withdrawal from the contract, the goods must therefore be delivered to the seller within the 14-day period from the conclusion of the purchase contract, not merely sent for transport, otherwise the withdrawal from the contract is considered invalid.
9.11 If the buyer fails to fulfill any of the obligations set out in points 9.4 and 9.5 of these General Terms and Conditions, the withdrawal from the purchase contract is not valid and effective, and the seller is not obliged to refund all demonstrable payments under point 9.8 of these General Terms and Conditions to the buyer, and at the same time is entitled to reimbursement of costs associated with sending the goods back to the buyer.
9.12 The buyer may not withdraw from a contract the subject of which is:
- a) the sale of goods made according to the buyer's special requirements, goods made to measure, or
- b) goods intended specifically for one buyer,
- c) the sale of goods sealed in protective packaging that are not suitable for return for health or hygiene reasons and whose protective packaging has been breached after delivery.
9.13 When issuing a credit note, the buyer may be required to provide an extract from the Commercial Register for the purpose of protecting the buyer's property rights.
10. Product Reviews
10.1 The seller reserves the right not to publish reviews for products that contain inappropriate expressions, are false, are not related to the given product, refer to external websites, or in any other way damage the name of our company.
11. Gift Vouchers (Certificates)
11.1 Gift vouchers (certificates) issued by the seller may be used for the purchase of goods on the seller's e-commerce website. Unless stated otherwise, the gift voucher may only be used for the purchase of goods, does not apply to services, postage costs, and other fees.
11.2 The value of the gift voucher is stated on each voucher as an amount including VAT, whereby the voucher functions as a discount on the total amount of the ordered goods including VAT. The gift voucher can only be used for its full value within a single purchase; it cannot be applied in parts. Any underpayment for the purchase of goods must be paid in monetary form; any overpayment will not be refunded.
11.3 The gift voucher cannot be exchanged for cash. If the buyer is entitled to withdraw from the purchase contract for the purchase of goods for which the buyer paid with a gift voucher, the buyer becomes entitled to a refund of the purchase price in the form of a gift voucher (by sending a gift voucher to the address provided by the buyer).
12. Final Provisions
12.1 The seller reserves the right to amend these General Terms and Conditions. The obligation to notify changes in these General Terms and Conditions in writing is fulfilled by placing them on the seller's e-commerce website.
12.2 If the purchase contract is concluded in writing, any amendment thereto must be in writing.
12.3 In case of doubt, the parties have agreed that the period of use shall be considered the period from the delivery of the goods to the buyer (including the day of delivery) according to point 5.6 of these General Terms and Conditions until the day of return of the goods to the seller, or handing over the goods to the courier for their transport to the seller.
12.4 The parties have agreed that communication between them shall take place mainly in the form of e-mail messages or by postal mail.
12.5 Relations not regulated by these General Terms and Conditions are governed by the relevant provisions of the Commercial Code.
12.6 These General Terms and Conditions become effective with respect to the buyer upon sending the electronic order by the buyer.
12.7 By ticking the box before sending the order, the buyer confirms that they have read and fully agree with these General Terms and Conditions.
